She said sometime in the first week of April the nomination phase will start.
Well like I said I remember WAY back when this post was still new she said April 1st lemme go quickly look through with ctrl F
yeh as of our info unstable or kat told us April 1st
Real talk, this most likely will have to change, as the prizes still haven’t been confirmed.
Small question, sorry if dupe but…
Have yall confirmed/found what specific day in April you might/do the gimkit awards?
Again, the prizes for the awards still have not been confirmed, so we will not begin to plan out the rest of the schedule until that is finished. We were going for april, and we still are, but we can’t guarantee anything.
I don’t want the awards to go prizeless, I still want the winners to win something for their hard work, so I hope you all understand if we’re forced to push it back.
I will most likely make a new topic on this within the next day or two.
Indeed they are, but we haven’t gotten it confirmed by staff to ensure that they would actually give them out. We were mostly working off of the logic that “They helped us with prizes last year, so they’ll do the same this year as quick as they can!” but it currently seems as if we’re being ignored. Likely not the fault of team gimkit, as they are very busy.
Nominations and voting will come out sometime in April hopefully. The team is waiting for info about the prizes and the awards can’t really happen until then.
Well, um, hello, sorry for the inconvenience. Twofour hasn’t been online all day and in the interest of allowing actual questions I set a slowmode but that clearly wasn’t really enough. I hope this didn’t really ruin anyone’s day (I think Pharlain once said something similar about the bot spam lol).
There is another Gimkit Awards topic-
wait, nope, that one’s closed-
Uh… yep I set it to open in a hour instead because I think everything will be taken care of by then
Sorry again.
Oh and thanks to all of you who helped out.
Will copies of popular games be counted as a potential candidate?
I don’t think so, somewhere someone mentioned that maps could be taken down due to copyright issues, like making FNAF, not 100% sure.
Wait wait a second I’m confused I thought Game remakes was something like If somebody were to make a Mario Game in Gimkit but now theres a copyright aspect. So won’t game remakes just be considered breaking a rule because of copyright . I know theres one thing that fits the game remake criteria and thats parody’s but are parody’s the only things that are considered game remakes ?. Sorry if this a duplicate post , I looked through but I couldn’ find anything on this , but I might have not looked close enough.
Well, not exactly. The “copyright” thing isn’t about making a recreation of a copyrighted game, it’s about copying an already existing Gimkit game.
Anything you create is protected with copyright law. Here is from www.copyright.gov:
“ In copyright law, there are a lot of different types of works, including paintings, photographs, illustrations, musical compositions, sound recordings, computer programs, books, poems, blog posts, movies, architectural works, plays, and so much more!”
So basically, Minecraft and Fnaf are all protected with this, so you can’t create an exact replica.
This is why using images from the web in thumbnails are not allowed. It’s protected with copyright law. Technically, all the artists’ thumbnails are copyrighted too, but they let us use them.
So what does that mean for creating games?
When you recreate games, you are using fair use laws. Here is an explanation provided by www.copyright.gov:
“ Fair use is a legal doctrine that promotes freedom of expression by permitting the unlicensed use of copyright-protected works in certain circumstances. Section 107 of the Copyright Act provides the statutory framework for determining whether something is a fair use and identifies certain types of uses—such as criticism, comment, news reporting, teaching, scholarship, and research—as examples of activities that may qualify as fair use. Section 107 calls for consideration of the following four factors in evaluating a question of fair use:
- **Purpose and character of the use, including whether the use is of a commercial nature or is for nonprofit educational purposes:**Courts look at how the party claiming fair use is using the copyrighted work, and are more likely to find that nonprofit educational and noncommercial uses are fair. This does not mean, however, that all nonprofit education and noncommercial uses are fair and all commercial uses are not fair; instead, courts will balance the purpose and character of the use against the other factors below. Additionally, “transformative” uses are more likely to be considered fair. Transformative uses are those that add something new, with a further purpose or different character, and do not substitute for the original use of the work.
- Nature of the copyrighted work: This factor analyzes the degree to which the work that was used relates to copyright’s purpose of encouraging creative expression. Thus, using a more creative or imaginative work (such as a novel, movie, or song) is less likely to support a claim of a fair use than using a factual work (such as a technical article or news item). In addition, use of an unpublished work is less likely to be considered fair.
- Amount and substantiality of the portion used in relation to the copyrighted work as a whole: Under this factor, courts look at both the quantity and quality of the copyrighted material that was used. If the use includes a large portion of the copyrighted work, fair use is less likely to be found; if the use employs only a small amount of copyrighted material, fair use is more likely. That said, some courts have found use of an entire work to be fair under certain circumstances. And in other contexts, using even a small amount of a copyrighted work was determined not to be fair because the selection was an important part—or the “heart”—of the work.
- Effect of the use upon the potential market for or value of the copyrighted work: Here, courts review whether, and to what extent, the unlicensed use harms the existing or future market for the copyright owner’s original work. In assessing this factor, courts consider whether the use is hurting the current market for the original work (for example, by displacing sales of the original) and/or whether the use could cause substantial harm if it were to become widespread.
In addition to the above, other factors may also be considered by a court in weighing a fair use question, depending upon the circumstances. Courts evaluate fair use claims on a case-by-case basis, and the outcome of any given case depends on a fact-specific inquiry. This means that there is no formula to ensure that a predetermined percentage or amount of a work—or specific number of words, lines, pages, copies—may be used without permission.”
If that’s the case, the game you made is definitely not legally distinct enough lol.
Also, game remake != remake of a video game inside gimkit
Any game will work, think soccer, football, not tag because there’s definitely too many of those, board games, whatever else.
Also we definantly will not be able to start the awards tomorrow, so be checking the gimkit awards tab for a new post about that.
What if a nominated map gets a major update AFTER the nomination?
That wouldn’t really affect anything would it?
I mean what if the map creator planned that, you know? Like it’s a major update that changes a good portion of the map, and it could swing the vote if it’s good.
Yeah, I mean I think a lot of people are going to do that. I’m planning to release a game whenever the awards start so I can get a chance at nomination. Strategies to get your map seen on trending during the awards are smart.
Well, when you release a game around the nomination time, it’s not going to be popular. Most likely these games have been out for months already.
Frankly, what do you expect us to do to prevent that?
Like, seriously. We can’t just magically stop people from updating their games. Disqualifying them for putting in effort is literally the antithesis of the awards in the first place.
