no you can recreate it just say that it is not a direct copy and that you don’t use the same name/ image for the thumbnail.

yeah, but as long as you don’t say that it is nintendo’s game, use the same thumbnail as nintendo’s game, and don’t say that it is not based on the original version, your good.
